General

These Terms and Conditions set forth an agreement between you and Media Union LTD (“we”, “us” or “our”) which fully operates and provides content on website froggie1.info.

„Media Union LTD is a member of WASPA and is bound by the WASPA Code of Conduct. Customers have the right to approach WASPA to lodge a complaint in accordance with the WASPA complaints procedure. Media Union LTD may be required to share information relating to a service or a customer with WASPA for the purpose of resolving a complaint. WASPA web site: www.waspa.org.za”

Website is located at www.froggie1.info (the “Site”). Payment Terms supplement the Terms and Conditions governing your use of the Froggie1 Services (the “Terms and Conditions”), which are incorporated here by reference. Any capitalized terms used in Payment Terms and not defined here will have the meanings set forth in the Terms and Conditions.

You may only open a Froggie1 account and/or use the Services if your acceptance of Payment Terms is not prohibited by applicable law. You must be 18 years of age or older in order to use the Services and have the bill-payers permission. By opening an account, downloading the Application, and/or otherwise using the Services, you represent that you are at least 18 years old.

If you do not agree any part of Terms and Conditions, you may not subscribe to the Services made available by Froggie1. By using any part of the Services, or by creating a user account, you signify your acceptance of the Terms and Conditions. You should review Terms and Conditions periodically. If we make amendments to any part of the Terms, we will post a notice on the Services and notify customers. You will be deemed to have accepted Terms, as amended, if you continue to use the Services after said notice has been posted.

This service must not be used to intentionally engage in illegal conduct. We will not knowingly create, store or disseminate any illegal content, infringe copyright or infringe any intellectual property rights. Service must not be used to send spam or promote sending of spam.

This terms and conditions applies to all of our current and incoming service names.

Paid services

Please note that any Payment Terms presented to you by us in the process of using or signing up for Froggie1 Paid Services are deemed part of this Agreement. You agree to pay for and authorize us to charge you for the cost of Paid Service, including applicable taxes and fees.

Reaffirmation of authorization

Your non-termination or continued use of a Paid Service reaffirms that we are authorized to charge you for the applicable subscription price for that Paid Service.

Your account

To use the Service – as a paid subscriber — you will need to create an account and provide certain registration information. As per our Terms and Conditions, you acknowledge that you are responsible for keeping your login credentials secure. You agree to accept responsibility for all activities that occur under your account. Media Union LTD reserves the right to, in its sole discretion, terminate or suspend accounts. In the event that Media Union LTD terminates your account due to actual or suspected violation of the Terms and Conditions or Payment Terms, services purchased in according with these Payment Terms or Terms and Conditions may be forfeited without any refund.

Privacy

Media Union LTD creates a mobile number database in order to keep the service functioning. Mo-bile number is only information Media Union LTD will ask for and gather from the user in order to allow customer to participate in the Service. By joining this Service, your mobile number will be placed in our distribution list. While in the distribution list, customer is eligible to receive updates on our services or promotions. To remove mobile number from the distribution list send STOP to 43635 (sending the message applies standard carrier SMS cost). User can also remove mobile number from the distribution list by sending an e-mail to info@froggie1.info or calling the support number at: 115074630.

Subscription process

To subscribe to the Service, please subscribe via Internet. Via Internet you can fill in your mobile phone number on the landing pages. After subscription via landing page, clients will receive a confirmation message about the successful registration. Subsequently, the first url to the content will be sent.

This is a subscription service R7/day. Subscribers have right to unsubscribe from the service at any time. Standard SMS rates apply. To unsubscribe, SMS stop to stop to 43635 (sending the message applies standard carrier SMS cost). Mobile offer is downloadable entertainment content, such as app reviews, app access, wallpapers & ringtones through its content wap site. Once you are registered you will be able to download content through the service to compatible mobile phones. Price includ-ed VAT. Billings errors are charged. Network fees may apply. Pricing

Offers or statements mentioned in advertisements or froggie1.info (“Website”) are without engagement unless it is expressly stated in writing otherwise.

Before the subscription starts the subscriber will receive a message with a short description of the service and the costs for each message. Thereafter, for every message received or sent a charge can incur depending on the type of message and/or billing method. On all messages sent and received the standard costs for sending texts messages, as set by the operators, may apply.

Froggie1 is at all times entitled to change any and all costs following prior announcement on the Website. Existing subscribers will receive an announcement by SMS two weeks in advance before the price change. Changes shall be deemed accepted if subscribers continue to use Froggie1 service after the date on which the price change is to be implemented.

Recurring billing

If you enroll for subscription-based Paid Services, you authorize Froggie1 or its payment processor to charge the applicable recurring subscription fees to your designated billing payment method. When you initially subscribe to such Paid Services, you will be charged immediately for the initial period of the subscription at the then-current fee. Some of the Paid Services may consist of an initial period, for which there is a one-time charge, followed by recurring periodic charges as specified on the Services. By choosing a recurring payment plan, you acknowledge that such Services have an initial and recurring payment feature and you accept responsibility for all recurring charges prior to cancellation.

Current information requirement

YOU MUST PROMPTLY NOTIFY US OR OUR PAYMENT PROCESSOR IF YOUR PAYMENT METHOD IS CANCELED (E.G., FOR LOSS OR THEFT) OR IF YOU BECOME AWARE OF A POTENTIAL BREACH OF SECURITY, SUCH AS THE UNAUTHORIZED DISCLOSURE OR USE OF YOUR LOGIN CREDENTIALS. IF YOU FAIL TO PROVIDE THE FOREGOING INFORMATION, YOU AGREE THAT WE MAY CONTINUE CHARGING YOU FOR ANY USE OF PAID SERVICES UNDER YOUR ACCOUNT UNLESS YOU HAVE TERMINATED YOUR PAID SERVICES AS SET FORTH ABOVE.

Limitation of liability, indemnity and release

NEITHER MEDIA UNION LTD NOR ANY OF ITS SUBSIDIARIES, DIVISIONS, AFFILIATES, AGENTS, REPRESENTATIVES OR LICENSORS SHALL BE LIABLE TO YOU OR ANYONE ELSE FOR ANY LOSS OR INJURY OR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR SIMILAR DAMAGES ARISING OUT OF YOUR ACCESS OR USE OF, OR YOUR INABILITY TO ACCESS OR USE, THE SERVICE AND THE INFORMATION AVAILABLE ON THE SERVICE OR ARISING OUT OF ANY ACTION TAKEN IN RESPONSE TO OR AS A RESULT OF ANY INFORMATION AVAILABLE ON THE SERVICE. YOU HEREBY WAIVE ANY AND ALL CLAIMS AGAINST MEDIA UNION LTD AND ITS SUBSIDIARIES, DIVISIONS, AFFILIATES, AGENTS, REPRESENTATIVES AND LICENSORS ARISING OUT OF YOUR USE OF THE SERVICE AND THE INFORMATION AVAILABLE THEREON. You accept all responsibility for, and hereby indemnify and hold us harmless from and against, any actions taken by any user authorized to use your account, including, but not limited to, disclosure of password codes to third parties. By using the Service, you release us, our subsidiaries, and affiliates from any and all liabilities regarding your participation in the Service. MEDIA UNION LTD has the right to take down any content, that is hosted as a part of the service that company considers illegal or for which has received a take-down notice. MEDIA UNION LTD has the right to suspend or terminate the services of any customer who does not comply with these terms and conditions or any other related contractual obligations. Froggie1 does not monitor or store the content of private messages that users send from the service and cannot in any way be held responsible for the content of user messages sent over the web or wap page provided by Media Union LTD.

Auto-renewal for subscription services

Subscription Services you have signed up for will be automatically extended for successive renewal periods of the same duration as the subscription term originally selected. For any queries please con-tact customer support at: info@froggie1.info.

Canceling paid subscriptions

Termination

If Media Union LTD believes that you have violated Payment Terms or the Terms and Conditions, we may suspend or terminate your access to the Services at any time, with or without cause, with or without notice, effective immediately, which may result in the forfeiture and destruction of all information associated with your account. Media Union LTD may also in its sole discretion, and at any time, modify or discontinue the subscription service, or any part thereof, with or without notice. You agree that Media Union LTD is not liable to you or any third-party for any interference with, or termination of your access to the subscription service.

Mobile use

Froggie1 is accessible on compatible mobile devices. An Internet enabled mobile device on which you have downloaded our applicable mobile Application is required. Standard data and usage charges instituted by your mobile carrier may apply (and are not included in any subscription fee paid for froggie1.info) and you are solely responsible for such charges. Check with your mobile car-rier regarding the terms of your individual data or usage plan.

These Payment Terms, together with the Terms and Conditions and Privacy Policy, constitute the entire agreement between you and Media Union LTD regarding your use of the Services. In the event of a conflict between these Payment Terms and the Terms and Conditions, these Payment Terms will govern.

Our privacy policy

1. Introduction

1.1. We are committed to safeguarding the privacy of our website users and our customers; in this policy, we explain how we will handle your personal data.
